Державна ідентичність: новий термін політичної та правової науки

Abstract

У статті вперше науково обґрунтована концепція державної ідентичності. На основі аналізу чинного законодавства, з’ясована контраверсійність легітимованих дефініцій національної та громадянської ідентичності. Стаття написана на основі підходів та концепцій політичного інституціоналізму, безпекознавства, Real Politik, етатизму, символічного інтеракціонізму, правової антропології щодо дослідження держави в умовах нелінійного розвитку в рамках певного геостратегічного ландшафту. Підкреслюючи на іманентну турбулентність міжнародної безпекової архітектури, масштабування поза правового впливу транснаціональних корпорацій на державну політику різних країн акцентовано на засадничій ролі держави та ефективно функціонуючої інституційної системи та її значенням для гарантування суверенітету. Наведено комплекс корелюючих детермінант державності і державної ідентичності. Встановлено дериват ключових термінів, що описують державну ідентичність: державність, державотворення, державна мова, державні інтереси, цінності держави, загрози державі, політика державної безпеки, територія держави, простір держави, територіальна цілісність, недоторканність державного кордону, суб’єктність Української Держави, міжнародно-правове визнання, непорушність конституційного ладу, заснованого на принципах балансу та розподілу влади. Здатність до забезпечення відповідних явищ, що описуються наведеними вище термінами, може становити комплекс ознак, що структурують та описують державну ідентичність як цілісне явище. Аргументовано необхідність виокремлення державної ідентичності як самостійного виду ідентичності і трактування її ключовою засадою реалізації державності. Наголошено, що розвиток теоретичних засад і практичне утвердження державної ідентичності відіграє стратегічну роль у творенні геостратегії і забезпеченні державної безпеки та стійкості Української Держави в умовах гібридної війни, внутрішніх загроз та глобальних трансформацій. У статті обґрунтовано неповноту досліджень, в яких акцент здійснено лише на національній та громадянській ідентичності, презентації цивілізаційної ідентичності поза контекстом державної. Подано аргументи щодо некоректності визначення поняття громадянської ідентичності у профільному законі. Сформовані пропозиції щодо утвердження державної ідентичності.

The article scientifically substantiates the concept of state identity for the first time. Based on an analysis of current legislation, the controversy surrounding the legitimized definitions of national and civic identity has been clarified. The article is written using approaches and concepts from political institutionalism, security studies, Realpolitik, etatism, symbolic interactionism, and legal anthropology in the context of studying the state under conditions of nonlinear development within a specific geostrategic landscape. By emphasizing the inherent turbulence of the international security architecture and the extralegal influence of transnational corporations on state policies in various countries, the article underscores the fundamental role of the state and its effectively functioning institutional system, as well as its importance in ensuring sovereignty. A set of correlating determinants of statehood and state identity is provided. The derivation of key terms that describe state identity has been established, including: statehood, state-building, state language, state interests, state values, threats to the state, state security policy, state territory, state space, territorial integrity, the inviolability of state borders, the subjectivity of the Ukrainian State, international legal recognition, and the inviolability of the constitutional order, which is based on the principles of balance and the separation of powers. The ability to ensure the phenomena described by these terms constitutes a set of features that structure and describe state identity as a holistic concept. The article argues for the need to distinguish state identity as a separate type of identity and to interpret it as a key foundation for the realization of statehood. It emphasizes that the development of theoretical foundations and the practical establishment of state identity play a strategic role in shaping geostrategy and ensuring the security and resilience of the Ukrainian State amidst hybrid warfare, internal threats, and global transformations. The article also highlights the incompleteness of studies that focus solely on national and civic identities, while presenting civilizational identity outside the context of state identity. Arguments are made regarding the incorrect definition of civic identity in the relevant law. Proposals for the establishment of state identity have been formulated.
