Забезпечення поточної легітимності представницьких органів влади як складник подолання суспільного розколу

Abstract

Стаття продовжує дослідження автором проблеми конструювання, спрямованої на подолання суспільного розколу виборчої системи. Розкривається категорія універсальної репрезентативності через аспект поточної легітимності. Застосовано аналогію виборів з інститутом представництва в праві. За допомогою концепції народного суверенітету обґрунтовується позиція прийнятності запровадження індивідуального імпічменту депутатів легіслатур. Окреслені напрями подальшої наукової розвідки інституційного механізму у виборчій сфері з метою консолідації суспільства.

The article continues the research of the author of the problem of designing aimed at overcoming the public split of the electoral system. The category of universal representativeness is revealed through the aspect of current legitimacy. The analogy of the election with the Institute of representation in the law was applied. With the help of the concept of popular sovereignty, the position of admissibility of the introduction of individual impeachment of deputies of the Legislatures is substantiated. The directions of further scientific research of the institutional mechanism in the electoral field for consolidation of society are outlined.
