Учасники відносин у сфері надання послуг заряджання електромобілів

Abstract

Урбанізація спричиняє негативні зміни екологічного стану міста. Одним з істотних джерел викидів у атмосферне повітря СО2 є саме автомобільний транспорт, без якого сучасне місто не може розвиватись. Для подолання негативного впливу на стан екології у межах сучасного мегаполіса використовується концепція «Smart Сity» (розумне місто). Розвиток використання електромобілів для транспортного забезпечення сучасного розумного міста може бути визначено як окрему складову на рівні з іншими факторами розумної мобільності. Проведений аналіз компетенції органів у сфері розвитку інфраструктури електромобільного транспорту у напрямку дозволяє дійти висновку, що таки-ми органами, які мають відповідні організацій-но-господарські повноваження для реалізації концепції «Smart City» розумне місто у практичній площині на загальнодержавному рівні є Верховна Рада України, Кабінет Міністрів України, Президент України; на центральному рівні – органи, діяльність яких прямо чи опосередковано спрямована на розвиток електромобільного транспорту, зокрема Мінінфраструктури, Укртрансбезпека, Мінцифри, Національна рада з відновлення України від наслідків війни, а на місцевому рівні – державні адміністрації, органи місцевого самоврядування тощо. Послуги з заряджання електромобілів у розумному місті «Smart City» можуть надаватись суб’єктами господарювання – юридичними особами або фізичними особами-підприємцями. Такі послуги не є постачанням електроенергії, а навпаки є споживанням електроенергії, а тому для їх надання не потрібна ліцензія. Недоліком є відсутність у КВЕД коду для такої господарської діяльності як послуга із зарядки електромобілів. Також надання послуг зарядки електромобілів можуть здійснюватися негосподарюючими суб’єктами. Іншими учасниками відносин у сфері надання послуг із заряджання електромобілів є суб’єкти господарювання, які забезпечують діяльність операторів ЕЗС. Важливим учасником відносин з надання послуг заряджання електромобілів є споживач. Перспективним напрямом подальших досліджень є розкриття правового забезпечення господарської діяльності операторів станцій заряджання електромобілів.

Urbanization causes negative changes in the ecological state of the city. One of the significant sources of CO2 emissions into the atmosphere is road transport, without which a modern city cannot develop. To overcome the negative impact on the state of ecology within the boundaries of a modern metropolis, the concept of «Smart City» is used. The development of the use of electric vehicles for transportation in a modern smart city can be defined as a separate component on a par with other factors of smart mobility. The conducted analysis of the competence of bodies in the field of development of the infrastructure of electric mobile transport in the direction allows us to come to the conclusion that the bodies that have the appropriate organizational and economic powers to implement the concept of «Smart City» at the practical level at the national level are the Verkhovna Rada of Ukraine, the Cabinet of Ministers of Ukraine, President of Ukraine; at the central level - bodies whose activities are directly or indirectly aimed at the development of electric transport, in particular the Ministry of Infrastructure of Ukraine, Ukrtransbezpeka, the Ministry of Digital Transformation, The National Council for the Recovery of Ukraine from the Consequences of the War, and at the local level – state administrations, local self-government bodies, etc. Electric vehicle charging services in the «Smart City» can be provided by business entities - legal entities or individual entrepreneurs. Such services are not electricity supply, but rather electricity consumption, and therefore no licence is required to provide them. A disadvantage is the absence of a code in the NACE for such economic activities as electric vehicle charging services. Also, the provision of electric vehicle charging services can be carried out by non-management entities, such as condominiums. Other participants in relations in the field of providing electric vehicle charging services are business entities that provide the activities of electric vehicle operators.An important participant in relations for the provision of electric vehicle charging services is the consumer. A promising direction for further research is the disclosure of the legal support for the economic activity of operators of electric vehicle charging stations.
