Abstract

Одним із важливих елементів національної безпеки та оборони країни є військовослужбовці. Соціальний, правовий захист та матеріальне забезпечення, сприятливі умови для реалізації їх конституційних прав є пріоритетними завданнями для держави.Забезпечення військовослужбовців житловим приміщенням є одним із ключових аспектів соціального захисту. Стан забезпечення військовослужбовців житлом не лише відображає ставлення суспільства до своїх захисників, а й має важливе стратегічне значення для забезпечення бойової готовності та морально-психологічного клімату у Збройних Силах України, Національній гвардії України та інших силах оборони. На законодавчому та організаційному рівнях система забезпечення житлом військовослужбовців в Україні залишається неефективною та такою, що містить значні корупційні ризики. Кардинальних змін потребують джерела чинного законодавства, які упорядковують право військових на житло. Радянське законодавство становить основу чинного житлового законодавства, є застарілим і не відповідає наявним ні політичним, ні соціально-економічним умовам, і потребує кардинальних змін. Всебічний аналіз різних періодів розвитку вітчизняного житлового законодавства надає можливість визначити ті обставини та причини, які дадуть змогу усунути недоліки правового регулювання житлових відносин та віднайти шляхи вдосконалення сучасного житлового законодавства шляхом запровадження нових механізмів житлового забезпечення військовослужбовців та членів їх сімей.У зв’язку з цим, важливо здійснити дослідження обставин і чинників, що впливають на правові аспекти впровадження нових алгоритмів забезпечення житлом військовослужбовців. Такий аналіз дозволить розкрити проблеми і недоліки запровадження нових механізмів забезпечення житлом зазначеної категорії осіб та визначити шляхи їх подальшого розвитку. Розглянуто питання реалізації програми доступної іпотеки «єОселя» для військовослужбовців. Здійснено аналіз іпотечного житлового кредитування, що полягає в наданні довгостро-кового банківського кредиту на придбання чи будівництво житлової нерухомості, де заставою є нерухоме майно. Вивчено вимоги до кандидатів на отримання пільгового іпотечного кредиту. Досліджено проблемні питання що виникають в процесі реалізації іпотеки.
