Кримінально-правова характеристика віку особи в постановах Пленуму Верховного Суду України

Abstract

Досліджено роз’яснення, які містяться в постановах Пленуму Верховного Суду України з кримінальних справ, що стосуються віку суб’єкта злочину та віку потерпілого від злочину. Проаналізовано відповідність цих роз’яснень положенням теорії кримінального права та нормам кримінального закону. Зроблено висновок, що окремі з них є сумнівними і недостатньо обґрунтованими. Ключові слова: вік, суб’єкт злочину, потерпілий від злочину, роз’яснення, Пленум Верховного Суду України.

The article deals with the clarifications of the age of the subject of the crime and the age of the victim of the crime contained in the plenum resolutions of the Supreme Court of Ukraine concerning criminal cases. The compliance of these clarifications with the principles of the theory of criminal law and the norms of criminal law is analyzed. It is concluded that some of them are questionable and inadequately substantiated. Key words: age, subject of the crime, victim of a crime, clarifications, the plenum of the Supreme Court of Ukraine.
