Житлова нерухомість як предмет злочинів проти власності

Abstract

Стаття присвячена вивченню житлової нерухомості як предмета злочинів проти власності. Проаналізовано різні точки зору науковців щодо встановлення предмета злочинів проти власності в сфері обороту житлової нерухомості. Автором обґрунтовується, що злочинні посягання, які вчиняються в сфері обороту житлової нерухомості, посягають не на житлову нерухомість як річ, предмет матеріального світу з певними фізичними властивостями і правовим статусом, а на сукупність визначених цивільним законодавством майнових прав, що належать законному власникові. The article is dedicated to the researching of housing estate as the subject of crimes against property. Different points of view of the scientists have been analyzed according to the establishment of the subject against property in the sphere of the turnover of housing estate. The author argues that criminal assaults, which are committed in the sphere of the turnover of housing estate, do not infringe the housing estate as a thing, the subject of material world with the certain physical characteristics and legal status; such criminal assaults infringe the complex of the property rights, enshrined by the civil legislation, which belongs to the legitimate owner.
