Правовий статус Верховного представника ЄС із питань закордонних справ і політики безпеки

Abstract

У статті досліджено правовий статус Верховного представника ЄС із питань закордонних справ і політики безпеки. З’ясовано, що Верховний представник ЄС із питань закордонних справ і політики безпеки призначається Європейською радою кваліфікованою більшістю голосів за погодженням із Головою Європейської комісії та за згодою Європейського парламенту. Верховний представник є відповідальним перед Європейською комісією, Радою ЄС і Європейським парламентом. Європейський парламент може оголосити вотум недовіри Європейській комісії, наслідком чого буде відставка й Верховного представника ЄС із питань закордонних справ і політики безпеки, який водночас зберігатиме свою посаду в Раді ЄС до призначення нового складу Європейської комісії. Верховний представник ЄС очолює Раду закордонних справ та сприяє своїми пропозиціями підготовці спільної зовнішньої й безпекової політики та забезпечує виконання рішень, схвалених Європейською радою та Радою ЄС. Верховний представник ЄС з питань закордонних справ і політики безпеки є одним із заступників Голови Європейської комісії. Основним завданням Верховного представника на цій посаді є забезпечення узгодженості та послідовності зовнішньої діяльності Європейського Союзу. Верховному представнику ЄС із питань закордонних справ і політики безпеки під час виконання його повноважень допомагає Європейська служба з питань зовнішньої діяльності. Визначено, що Верховний представник ЄС із питань закордонних справ і політики безпеки виконує такі завдання: участь у роботі Європейської ради; проведення та імплементація СЗП-ПБ; роль заступника Голови Європейської комісії; управління ЄСЗД, уключаючи представництва ЄС; медіація; запит до Комітету з питань політики та безпеки щодо отримання висновку у СЗП-ПБ; право на розробку проєкту СПБО (можливо, спільно з Європейською комісією); координація цивільних і військових аспектів; керівництво місією, доручене Радою ЄС групі держав-членів; співробітництво щодо реалізації структурної співпраці.

The article examines the legal status of the high representative of the European Union for foreign affairs and security policy. It has been discovered that the High Representative of the EU for foreign affairs and security policy is appointed by the European Council by a qualified majority of votes in agreement with the President of the European Commission and with the consent of the European Parliament. The High Representative is responsible to the European Commission, the Council of the EU and the European Parliament. The European Parliament can announce a vote of no confidence in the European Commission, which will result in the resignation of the EU High Representative for Foreign Affairs and Security Policy, who will at the same time retain his position in the Council of the EU until the appointment of a new member of the European Commission.The High Representative of the EU heads the Council of Foreign Affairs and contributes with his proposals to the preparation of a common foreign and security policy and ensures the implementation of decisions approved by the European Council and the Council of the EU. The High Representative of the EU for Foreign Affairs and Security Policy is one of the deputy heads of the European Commission. The main task of the High Representative in this position is to ensure the coherence and consistency of the external activities of the European Union. The high representative of the EU for foreign affairs and security policy is assisted by the European External Action Service in the exercise of his powers. It was determined that the High Representative of the European Union for Foreign Affairs and Security Policy performs the following tasks: participation in the work of the European Council; conducting and implementation of common foreign policy and security policy; the role of the Deputy Chairman of the European Commission; management of the EEAS, including EU representations; mediation; a request to the Committee on Policy and Security to obtain an opinion from the common foreign policy and security policy; the right to develop the CSDP project (perhaps jointly with the European Commission); coordination of civil and military aspects; management of the mission assigned by the Council of the EU to a group of member states; cooperation on the implementation of structural cooperation.
