Конституційний транзит: окремі питання теорії

Abstract

Стаття присвячена дослідженню феномену конституційного транзиту та його особливостей в контексті сучасного розвитку України. Автор розглядає конституційний транзит як складний, багатовимірний процес, що охоплює широкий спектр правових, політичних та соціальних змін. У роботі аналізуються теоретичні засади конституційного транзиту, його окремі етапи та ключові фактори, що впливають на успішність демократичних перетворень.Особлива увага приділяється специфіці конституційного транзиту в Україні, зокрема в умовах російсько-української війни та post-bellum періоду. Автор виділяє основні проблеми, з якими стикається Україна в процесі конституційних трансформацій, включаючи нестабільність демократичних інститутів, обмеженість економічного потенціалу та кризові явища в культурному середовищі. У статті пропонується аналіз можливих етапів конституційної трансформації України після завершення війни, включаючи невідкладні зміни для забезпечення національної безпеки, розробку комплексної стратегії реформ, громадське обговорення змін, законодавчий процес та імплементацію прийнятих рішень.Автор підкреслює необхідність врахування національних особливостей, історичних традицій та суспільного менталітету при проведенні конституційних реформ. Наголошується на важливості створення такої інституційної конституційної системи, яка б ефективно координувала діяльність усіх суспільних підсистем та регулювала поведінку учасників трансформаційних процесів. Дослідження демонструє, що конституційний транзит в Україні є частиною глобального процесу демократизації, але має свої унікальні риси, зумовлені історичним досвідом та сучасними викликами. Стаття торкається й розуміння складності та багатогранності процесів конституційної трансформації в перехідних суспільствах.

The article is devoted to the study of the phenomenon of constitutional transit and its features in the context of modern development of Ukraine. The author considers constitutional transit as a complex, multidimensional process that encompasses a wide range of legal, political, and social changes. The paper analyzes the theoretical foundations of constitutional transit, its individual stages, and key factors influencing the success of democratic transformations.Particular attention is paid to the specifics of constitutional transit in Ukraine, especially in the context of the Russian-Ukrainian war and the post-bellum period. The author identifies the main problems faced by Ukraine in the process of constitutional transformations, including the instability of democratic institutions, limited economic potential, and crisis phenomena in the cultural environment.The article offers an analysis of possible stages of constitutional transformation in Ukraine after the end of the war, including urgent changes to ensure national security, development of a comprehensive reform strategy, public discussion of changes, legislative process, and implementation of adopted decisions.The author emphasizes the need to take into account national characteristics, historical traditions, and social mentality when conducting constitutional reforms. The importance of creating an institutional constitutional system that would effectively coordinate the activities of all social subsystems and regulate the behavior of participants in transformational processes is emphasized.The study demonstrates that constitutional transit in Ukraine is part of the global process of democratization, but has its unique features due to historical experience and modern challenges. The article also touches upon the understanding of the complexity and multifaceted nature of constitutional transformation processes in transitional societies.
