Становлення зовнішніх функцій держави у практиці українського державотворення

Abstract

Україна є вільною та незалежною державою з юридичної точки зору. Однак сьогодні, в умовахзовнішньої військової агресії, наша держава змушена відстоювати своє право на незалежність. Така ситуація зумовлює потребу напрацювання дієвих механізмів державотворення та державо-відновлення, докорінної ревізії наявних підходів у цьому зв’язку. Відомо, що призначення кожноїдержави має свою динаміку. Вона залежить від певного стану суспільства, соціальних завдань таконкретизується насамперед у відповідних напрямках її діяльності – функціях. За найбільш поширеним в науковій літературі визначенням під функціями держави слід розуміти основні напрямкиїї діяльності. У статті наголошується, що практика державотворення кожної держави проходитьсвої історичні шляхи. Дослідження історичних подій є актуальним для більшості сфер науковихпошуків, оскільки це дає змогу розглядати питання значно ширше. З цієї причини дослідженнястановлення зовнішніх функцій держави у практиці українського державотворення не підпадаєпід виключення. Історико-правові аспекти ґенези зовнішніх функцій України на шляху до пошукупокращення елементів сучасного державотворення є вкрай важливими та актуальними, адже належне їх вивчення дає можливість реального відображення такого ж тривалого та складного шляху, як і історія становлення самої держави. Становлення зовнішніх функцій має давні традиції, завжди є актуальним та вкрай важливим на етапі проведення правового аналізу в загальній системі юридичних наук, насамперед в науці теорії та історії держави і права. Даною науковою статтеюаналізуються періоди додержавних утворень, а також правління визначних князів Київської Русі,які заклали міцний фундамент української державності. Відзначається, що впродовж багатьохроків вже після розпаду Київської Русі становище, як і саме формування зовнішніх функцій, буломалореалізованим. Новий історичний етап у розвитку української дипломатії наступив після 16 липня 1990 року, коли Верховна Рада прийняла Декларацію про державний суверенітет України. Це дало можливість якісного забезпечення реалізації зовнішніх функцій України у наступні історичні періоди.

Ukraine is a free and independent state from a legal point of view. However, today, in the conditionsof external military aggression, our state is forced to defend its right to independence. Such a situationnecessitates the development of effective mechanisms for state creation and state restoration, and afundamental revision of existing approaches in this regard. It is known that the appointment of eachstate has its own dynamics. It depends on a certain state of society, social tasks and is specified primarilyin the relevant directions of its activity - functions. According to the most common definition in thescientific literature, the functions of the state should be understood as the main directions of its activity.The article emphasizes that the practice of state formation in each state follows its own historical path.The study of historical events is relevant for most areas of scientific research, as they allow to consider issues much more broadly. For this reason, the study of the formation of the external functions of the state in the practice of Ukrainian state-building is not excluded. Historical and legal aspects of the genesis of Ukraine’s external functions on the way to the search for improving the elements of modern state-building are extremely important and relevant, because their proper study provides an opportunity to reflect the same long and complex path as the history of the formation of the state itself. The formation of external functions has long traditions, is always relevant and extremely important at the stage of legal analysis in the general system of legal sciences, primarily in the science of theory and history of the state and law. This scientific article analyzes the periods of pre-state formations, as well as the reigns of notable princes of Kyivan Rus, who laid a solid foundation for Ukrainian statehood. It is noted that for many years already after the disintegration of Kyivan Rus, the situation, as well as the formation of external functions, was poorly implemented. A new historical stage in the development of Ukrainian diplomacy came after July 16, 1990, when the Verkhovna Rada adopted the Declaration on State Sovereignty of Ukraine. This made it possible to qualitatively ensure the implementation of Ukraine’s external functions in the following historical periods.
