Процес ухвалення рішень у зовнішньополітичній сфері ЄС: проблеми та перспективи реформування

Abstract

Авторами статті доведено, що розвиток процесу ухвалення рішень у зовнішньополітичній сфері ЄС пройшов певні етапи, серед яких: формування первинного співробітництва між країнами ЄС щодо ухвалення рішень у зовнішньополітичній сфері; закріплення спільних засад партнерства між країнами-учасницями ЄС щодо ухвалення рішень у зовнішньому секторі; посилення спільних засад партнерства на рівні держав-учасниць ЄС щодо ухвалення рішень у зовнішньополітичній сфері. Зазначено, що вказані еволюційні стадії супроводжувались змінами нормативно-правового забезпечення відносин, організаційного регулювання та процедури в цілому. Визначено, що трансформації досліджуваного процесу відбувались під дією зовнішніх чинників, одним з яких стало повномасштабне вторгнення РФ в Україну і потреба мобілізації ініціатив ЄС стосовно підтримки української сторони. Виокремлено ключові проблеми, серед яких: прийняття рішень на основі одностайності між двадцятьма сімома різними країнами, яке обмежує ініціативи більшості, нечіткий розподіл ролей між різними інституційними учасниками. Сформульовано основні шляхи подолання проблем, які передбачають: запровадження голосування кваліфікованою більшістю, яке може використовуватись стосовно виняткових питань у зовнішньополітичній сфері ЄС, що потребують підтримки більшості; впорядкування інституційної інфраструктури, яка передбачає посилення відділу зовнішніх зв’язків Європейської Комісії та зміцнення зовнішньополітичного потенціалу Ради ЄС.

The authors of the article prove that the development of the decision-making process in the foreign policy sphere of the EU went through certain stages, including: the formation of primary cooperation between the EU countries regarding decision-making in the foreign policy sphere; consolidation of common principles of partnership between EU member states regarding decision-making in the external sector; strengthening the common principles of partnership at the level of the EU member states regarding decision- making in the foreign policy sphere. It is noted that the specified evolutionary stages were accompanied by changes in the regulatory and legal provision of relations, organizational regulation and procedures in general. It was determined that the transformations of the researched process took place under the influence of external demands, one of which was the full-scale invasion of the Russian Federation into Ukraine and the need to mobilize EU initiatives to support the Ukrainian side. Key problems are highlighted, including: decision-making based on unanimity between twenty-seven different countries, which limits majority initiatives, unclear division of roles between different institutional participants. The main ways of overcoming it have been formulated, which include: the introduction of qualified majority voting, which can be used in relation to exceptional issues in the EU’s foreign policy sphere that require the support of the majority; streamlining of the institutional infrastructure, which involves strengthening the external relations department of the European Commission and strengthening the foreign policy potential of the Council of the EU.
