Участь громадян у здійсненні правосуддя як форма взаємодії судової влади та громадськості

Abstract

У статті аналізується участь громадян у здійсненні правосуддя як одна із форм взаємодії громадськості і судової влади; визначаються позитивні і негативні сторони інститутів народних засідателів та присяжних. Розглядається інститут посередництва (медіації) як спосіб альтернативного розв’язання спорів за участю громадськості та інститут громадських мирових суддів як один із можливих варіантів участі громадськості у безпосередньому здійсненні правосуддя.

This article deals with the participation of citizens in the administration of justice as one of the forms of interaction between the public and the judiciary. Is determined the positive and negative aspects of the institutes of lay judges and of jury system. Institute of mediation as a method of alternative dispute resolution involving the public and the institution of public magistrates as one of the possible participation of the public in the direct administration of justice are considered.
