Моделі державно-церковних відносин у сучасній правовій практиці

Abstract

Здійснено аналіз сучасних моделей відносин між державою, церквою та суспільством у країнах Центрально-Східної Європи. Відзначено, що в історико-політологічному контексті моделями державно-церковних відносин є теократія, цезоропапізм, панівне становище церкви в державі, відокремлення церкви від держави, проміжний стан між державною церквою та моделлю повного відокремлення церкви й держави. Звернено увагу на те, що визначення «своєї» моделі для кожної країни є індивідуальним і залежить від багатьох чинників, насамперед від політико-правових устоїв, прийнятих у суспільстві, традицій, духовного й матеріального стану суспільства тощо. Аналізується принцип відокремлення держави від церкви в сучасній світовій практиці. Уточнюється теза про неможливість втручання церкви в справи держави за активного втручання державних інституцій у справи церкви. Констатовано, що розбудова Європи не може відбуватися шляхом поширення на інші країни, у тому числі й посткомуністичні, певної національної моделі державно-конфесійних взаємин.

The analysis of contemporary models of relations between state, Church and society in the countries of Central Europe. It is noted that in the context of historical and political science models of church-state relations are theocracy tsezoropapizm, the dominant position of the church in the state, the separation of church and state, an intermediate state between the state church model and the complete separation of church and state. Attention is drawn to the fact that the definition of “home” model for each country is individual and depends on many factors, primarily on the political and legal foundations accepted in society, traditions, spiritual and material state of society and so on. It analyzes the principle of separation of church and state in modern international practice. It clarifies the thesis of the impossibility of intervention of the church in state affairs with the active intervention of state institutions in the affairs of the church. It notes that the development of Europe may not occur by spreading to other countries, including post-communist, a certain national model of church-state relations.
