Конституційно-правові ідеї як фактор розбудови правової держави (період Античності та Середньовіччя)

Abstract

Автор характеризує ідеї конституціоналізму періоду Античності та середньовіччя, а також визначає їх науково-теоретичне та науково-практичне значення для реформування державно-правових інституцій. Аналіз теоретичних розробок мислителів Античних часів і середньовіччя засвідчує їх упевненість у необхідності введення принципу відповідального й справедливого правління; дотримання закону як усеоб’єднуючого фактору функціонування суспільства та держави; захисту й гарантування природних прав особи тощо. Спадковість сучасних засад організації держави та тогочасних ідеалів виявляє певні традиції формування конституційної моделі.

The author describes the ideas of constitutionalism period of Antiquity and the Middle Ages, and also determines their scientific-theoretical, scientific and practical importance for the reform of state-legal institutions. The analysis of the theoretical thinkers of antiquity and the Middle Ages confirms their confidence in the necessity of introducing the principle of responsible and equitable governance; compliance with law as a unifying factor of the functioning of society and the state; the protection and safeguarding of natural rights, etc. Heredity modern principles of organization of the state and then of ideals reveals certain tradition of the formation of the constitutional model.
