Зовнішнє і внутрішнє в праві: методологічні аспекти

Abstract

Стаття присвячена аналізу категорій «внутрішнє» й «зовнішнє» в праві та їх співвідношенню. У юридичній науці зазначена проблема майже не досліджена, незважаючи на використання термінів «внутрішнє» й «зовнішнє» під час розгляду сутності, змісту, форми, структури права тощо. При цьому зовсім не з’ясовано питання, чому, наприклад, форма права поділяється на внутрішню та зовнішню, що в праві дійсно є внутрішнім, а що зовнішнім, тому потребує розгляду методологічних аспектів цієї теми.

The article is devoted to the analysis of the categories “internal” and “external” in law and their correlation. In the legal science this problem is not studied despite application of terms “internal” and “external” while considering the essence, contents, form, structure of law etc. Herewith, there is no clarification to questions, why, for instance, the form of law is divided into internal and external ones, what is really internal and external in law. Therefore, methodological aspects of this topic require to be considered.
