Виникнення поняття «правова позиція Конституційного Суду України»

Abstract

У статті аналізуються особливості виникнення поняття «правова позиція Конституційного Суду України» в науці конституційного права. Зроблено висновок, що процесуальні форми реалізації доктрини конституційного судочинства знаходять свій прояв у правових позиціях органу конституційної юрисдикції, які відображені в мотивувальній та резолютивній частинах відповідних рішень, висновків і впливають на розвиток системи законодавства.

This article analyzes the features of emergence of the concept of “legal position of the Constitutional Court of Ukraine” in the science of constitutional law. It is concluded that procedural forms of implementation of the doctrine of constitutional justice find their expression in the legal opinions of the constitutional jurisdiction, which are reflected in the reasoning and the operative part relevant decisions, conclusions and influence the development of the legal system.
