Інститут контрасигнатури в системі стримувань і противаг

Abstract

Конституційний інститут контрасигнатури, який полягає у скріпленні акта глави держави підписами глави та членів уряду, без якого акт не набирає юридичної сили, розглядається як засіб зняття юридичної відповідальності з глави держави за видані ним акти і покладення її на уряд, і як засіб впливу уряду на главу держави в системі стримувань і противаг. Узагальнюється зарубіжний досвід використання інституту контрасигнатури. З’ясовуються особливості застосування інституту контрасигнатури за різних форм державного правління. Інститут контрасигнатури застосовується в країнах з парламентарними (парламентарна монархія, парламентарна республіка) і змішаною республіканською формами державного правління. У парламентарних монархіях і парламентарних республіках контрасигнуються всі або майже всі акти глави держави. Застосування інституту контрасигнатури за змішаної форми республіканського правління здійснюється у значно меншому обсязі і залежить від різновиду змішаної форми: президентсько-парламентарного чи парламентарно-президентського. У парламентарно-президентській республіці інститут контрасигнатури використовується у значно більшому обсязі, ніж у президентсько-парламентарній республіці, і наближається до контрасигнування в парламентарній республіці. Інститут контрасигнатури не використовується у класичній президентській республіці, де президент є главою виконавчої влади, немає уряду як колегіального органу і посади прем’єр-міністра, міністри призначаються і звільняються з посади президентом, несуть перед ним політичну відповідальність. Аналізуються зміни інституту контрасигнатури в конституційній практиці незалежної України. Наголошується на необхідності застосування інституту контрасигнатури як засобу обмеження влади Президента України і підвищення ролі Кабінету Міністрів України у здійсненні державної влади.

The constitutional institute of countersignature, which consists in binding an act of the head of state with the signatures of the head and members of the government, without which the act does not enter into legal force, is considered as a means of removing legal responsibility from the head of state for the acts issued by him and imposing it on the government, and as a means of government influence on the head of state in the system of checks and balances. The author summarizes the foreign experience of using the institute of countersignature. The author identifies the peculiarities of the use of the countersignature institute under different forms of government. The institute of countersignature is used in countries with parliamentary (parliamentary monarchy, parliamentary republic) and mixed republican forms of government. In parliamentary monarchies and parliamentary republics, all or almost all acts of the head of state are counter-signed. The use of the institute of countersignature in a mixed republican form of government is carried out to a much lesser extent and depends on the type of mixed form: presidential-parliamentary or parliamentary-presidential. In a parliamentarypresidential republic, the institution of countersignature is used to a much greater extent than in a presidential-parliamentary republic, and is close to countersignature in a parliamentary republic. The institute of countersignature is not used in a classical presidential republic, where the president is the head of the executive branch, there is no government as a collegial body and no prime minister, ministers are appointed and dismissed by the president and are politically responsible to him. The author analyzes changes in the institution of countersignature in the constitutional practice of independent Ukraine. The author emphasizes the need to use the institute of countersignature as a means of limiting the power of the President of Ukraine and enhancing the role of the Cabinet of Ministers of Ukraine in the exercise of state power.
