Юридичні аспекти забезпечення академічної відповідності кваліфікації науково-педагогічного працівника

Abstract

У статті досліджуються питання правового забезпечення вимоги про відповідність академічної кваліфікації науково-педагогічного працівника освітнім компонентам, які він викладає у процесі реалізації освітньої програми у закладі вищої освіти. Науково-педагогічні працівники, які викладають освітні компоненти для забезпечення освітньої програми мають статус викладачів закладів вищої освіти відповідно до Професійного стандарту на групу професій «Викладачі закладів вищої освіти». У законодавстві спостерігаються розбіжності в термінології, адже в одних випадках застосовуються терміни «академічна кваліфікація», а в інших – «освітня кваліфікація». У праці доведено, що інформація про освітню кваліфікацію викладача закладу вищої освіти відображена у відомостях про освіту, науковий ступінь та вчене звання, а про професійну кваліфікацію – у даних про досвід професійної діяльності та показниках професійної й наукової активності викладача закладу вищої освіти. Освітня та професійна кваліфікація у сукупності відображають академічну кваліфікацію викладача закладу вищої освіти. Ліцензійні умови провадження освітньої діяльності в Україні вимагають, щоб академічна кваліфікація викладача закладу вищої освіти відповідала освітній програмі та освітнім компонентам. Така відповідність підтверджується спеціальністю (за документом про вищу освіту, про науковий ступінь) або практичним досвідом у сфері професійної чи управлінської діяльності за безпосереднім предметом освітнього компонента (навчальної дисципліни). Вимога про відповідність академічної кваліфікації викладача закладу вищої освіти тим освітнім компонентам, які він забезпечує для реалізації освітньої програми, встановлена законодавством. Тому її слід вважати одним із критеріїв добору претендентів на посаду науково-педагогічного працівника. Відповідність академічної кваліфікації викладача освітнім компонентам одночасно засвідчує і відповідність профілю кафедри. Недотримання цієї вимоги виключає правозгідне зайняття особою відповідної посади викладача закладу вищої освіти.

In the article the questions of the legal providing of requirements for compliance with the academic qualification of a scientifically-pedagogical worker are investigated to the educational components that he lays out in the process of realization of the educational program in establishment of higher education. Scientifically-pedagogical workers that provide educational components for realization of the educational program have status of teachers of establishments of higher education in accordance with the Professional standard on the group of professions «Teachers of establishments of higher education». In a legislation there are divergences in terms; a term «academic qualification» is used in one law, and in other normatively-legal acts is «educational qualification». In the article an author proves that educational qualification of teacher of establishment of higher education is incarnated in information about education and scientific degree; and professional qualification is incarnated in practical professional activity and indexes of scientific activity of teacher of establishment of higher education. Together educational and professional qualification present academic qualification of teacher of establishment of higher education.The licensed requirements of realization of educational activity require in Ukraine, that qualification of teacher of establishment of higher education answered the educational program and educational components that he provides. Such accordance must be confirmed by speciality (in accordance with documents about higher education, about a scientific degree) or practical experience in the field of professional or administrative activity according to the article of educational component (educational discipline).Requirement about accordance of academic qualification of teacher of establishment of higher education to those educational components that he provides for realization of the educational program, envisaged by a law. Therefore, she belongs to the criteria according to that the selection of pretender is conducted on position of scientifically-pedagogical worker. Accordance of academic qualification of teacher simultaneously certifies his accordance of profile of department educational components. Violation of this requirement does not allow legitimately to hold a position of teacher of establishment of higher education.
