Основні аспекти взаємодії Європейського суду з прав людини з національною судовою системою України

Abstract

У статті висвітлено актуальні проблеми взаємодії Європейського суду з прав людини з Конституційним Судом та Верховним Судом України. Вказано на особливу роль Верховного Суду України в реалізації рішень і застосуванні практики Європейського суду з прав людини. Обґрунтовано, що робота Конституційного Суду України характеризується зростанням прикладів застосування рішень Страсбурзького суду, що, у свою чергу, свідчить про значний вплив рішень Європейського суду з прав людини на розвиток правової системи України в рамках європейської правової традиції.

The article covers the actual problems of interaction of the European court of human rights with the Constitutional Court and the Supreme Court of Ukraine. Indicates a special role of the Supreme Court of Ukraine in the implementation of decisions and application of practice of the European court of human rights. It is argued that the work of the constitutional Court of Ukraine is characterized by the growth of the Strasbourg’ decisions, that, in turn, indicates a significant influence of the decisions of the European court of human rights on the development of the legal system of Ukraine in context of European legal tradition.
