Влада як детермінант права: філософсько-правова інтерпретація

Abstract

Влада і право є концептами, що зазвичай розглядаються у вузькому контексті примусовості правових норм. Влада є чимось зовнішнім щодо права. Однак у статті пропонується підхід, відповідно до якого владний характер права зумовлений самим існуванням правової реальності. Запропоновано три аспекти такого підходу: перший пов’язаний із проблемою легітимації права, другий визначається проблемою авторитетності права, а третій – його об’єктивності.

Power and law are the concepts that are generally considered in the narrow context of coercion of law. The power is something external to the law. However, author proposes an approach under which the imperious nature of law caused by the existence of legal reality; in that case power is a feature of law. Article examines three aspects of this approach: the first is associated with the problem of legitimation of law; second is defined by the problem of authority of law, and the third by its objectivity.
