Пізнавальні конструкції дослідження сучасної правової системи України: фундаментальні та прикладні питання

Abstract

У статті запропоновано визначення поняття «ідентифікаційний код правової системи» (впорядкована сукупність найсуттєвіших юридичних ознак конкретного типу, які відображають особливості інституційної, функційної і нормативної частин правової системи) й основних його показників, які є юридичними критеріями для ідентифікації правової системи України з континентальним типом; визначено поняття «індикатор функціонування та розвитку правової системи» – система показників відповідного стану її функціонування та розвитку; встановлено основні ти-пові показники функціонування й розвитку правової системи, показники допустимих відхилень і прогресивного й регресивного стану; згадуваний індикатор використано для характеристики сучасної правової системи України, для встановлення реального стану її функціонування і розвитку. Завдяки застосуванню пізнавальних конструкцій «ідентифікаційний код правової системи» й «індикатор функціонування та розвитку правової системи України» зроблено висновок, що правова система України є однією із систем континентального типу, оскільки їй властиві відповідні ідентифікаційні ознаки. Встановлено, що показники взаємодії правової системи України й міждержавних правових систем загалом відповідають пізнавальним конструкціям; показники допустимих відхилень і прогресивного стану чітко не виявляються, але фіксуються деякі показники регресивного стану, зокрема: часто спостерігається відсутність належної взаємодії за наявності формальних показників; порушується низка принципів міжнародного права (насамперед безпекових); простежуються деформації взаємодії з боку і міждержавних правових систем, і правової системи України; відбувається перманентне реформування правової системи України, яке не відповідає сучасним реаліям.Дослідження сучасної правової системи України з використанням зазначених пізнавальних конструкцій дало змогу не тільки ідентифікувати правову систему України з континентальним правом, а й виявити особливості її інституційної, функційної й нормативної частин; розкрити зміст типових показників правової системи України і проблеми, які виникають у процесі функціонування національної правової системи; встановити її взаємозв’язок з іншими правовими системами цього типу, універсальними правовими системами (ООН) та європейськими регіональними міждержавними правовими системами.

The article proposes a definition of the concept of «identification code of the legal system» (an ordered collection of the most essential legal features of a specific type, which reflect the peculiarities of the institutional, functional and normative parts of the legal system) and its main indicators, which are legal criteria for identifying the legal system of Ukraine with a continental type; the concept of «indicator of functioning and development of the legal system» is defined – a system of indicators of the corresponding state of its functioning and development; the main typical indicators of the functioning and development of the legal system, indicators of permissible deviations and progressive and regressive state are established; the mentioned indicator is used to characterize the modern legal system of Ukraine, to establish the real state of its functioning and development. Thanks to the application of the cognitive constructions «identification code of the legal system» and «indicator of the functioning and development of the legal system of Ukraine», it was concluded that the legal system of Ukraine is one of the systems of the continental type, as it has the corresponding identification features. It was established that the indicators of the interaction of the legal system of Ukraine and international legal systems generally correspond to cognitive constructions; indicators of permissible deviations and a progressive state are not clearly identified, but some indicators of a regressive state are recorded, in particular: there is often a lack of proper interaction in the presence of formal indicators; a number of principles of international law (primarily security ones) are violated; the deformations of interaction on the part of both interstate legal systems and the legal system of Ukraine are traced; there is a permanent reform of the legal system of Ukraine, which does not correspond to modern realities.The study of the modern legal system of Ukraine using the specified c cognitive constructions made it possible not only to identify the legal system of Ukraine with continental law, but also to reveal the peculiarities of its institutional, functional and regulatory parts; reveal the content of typical indicators of the legal system of Ukraine and the problems that arise in the process of functioning of the national legal system; establish its relationship with other legal systems of this type, universal legal systems (UN) and European regional interstate legal systems.
