| Abstract: | У статті розглядається питання необхідності тлумачення правових норм як обов’язкового елементу процесу реалізації права. Об- ґрунтовується твердження, що без тлумачення неможливо встановити точний зміст і сферу дії юридичних норм, визначити їхнє місце в загальній системі правового регулювання. Автор звертає увагу на те, що тлумачення покликано протидіяти спробам відійти від змісту правових норм, з’ясувати те, що сформулював законодавець, протиставляти дух та букву закону. Ключові слова: тлумачення правових норм, реалізація правових норм, мовно-логічна форма правових норм, юридичні терміни, системність правових норм. |
| Description: | The issue of the necessity of the interpretation of legal norms as the obligatory element of the law realization process is considered. The statement that without interpretation it is impossible to find the exact content, the sphere of action and place in the system of legal regulation is proved. The author pays attention to the point that interpretation aims to resist attempts to deviate the content of legal norms, find the true content of law and withstand the spirit and the letter of law. Key words: interpretation of legal norms, realization of legal norms, linguistic and logic form of legal norms, legal terms, consistency of legal norms. |
