| Abstract: | Стаття присвячена висвітленню правової природи та сутності медіації як інституту альтернативного вирішення приватно-правових спорів. Визначено особливості правового регулювання процедурних та методологічних аспектів медіації чинними міжнародно-правовими документами. Проаналізовано світовий досвід високорозвинутих країн в застосуванні медіації та положення законодавства, що регулю- ють її здійснення, враховуючи особливості існуючих правових систем. Висвітлено реалії та передумови законодавчого запровадження медіації в Україні. Ключові слова: медіація, медіатор, альтернативні способи вирішення спорів, приватно-правовий спір, правовий конфлікт. |
| Description: | The article is devoted to the legal nature and main point of mediation as an institute of alternative resolution of the private-legal disputes. The features of the legal regulation of mediation procedure and methodological aspects fixed by the international legal documents in force have been determined. The worldwide experience of highly developed countries in mediation use and legislation regulations that regulated implementation of the mediation in accordance to the legal systems features has been analyzed. The actuals and requisites of the legislative mediation introduction in Ukraine have been covered. Key words: mediation, mediator, alternative ways to resolve disputes, private-legal disputes, legal conflict. |
