| Abstract: | У статті висвітлюються проблемні питання, що стосуються законодавчого врегулювання процесуального порядку вчинення такої нотаріальної дії, як видача свідоцтва про право на спадщину. Визначаються та аналізуються процесуально-процедурні аспекти поста- новлення та видачі свідоцтва про право на спадщину у разі посвідчення договору поділу спадкового майна. Досліджується порядок оформлення спадщини та поділ спадкового майна, а саме проблема невизначеності у законодавстві послідовності процесуальних дій щодо посвідчення договору про поділ спадкового майна і видачі свідоцтва про право на спадщину. Ключові слова: свідоцтво про право на спадщину, нотаріальне провадження, нотаріальна дія, нотаріус, нотаріальний процес. |
| Description: | The article examines problem questions related to the legislative settlement of judicial order of commit of such notarial action as a certification the right on an inheritance. The author determines and analyses judicially-procedural aspects of decision and issuing of a certificate of a right on an inheritance in the case of certification of agreement of division of the inherited property. He investigates the order of registration of inheritance and division of the inherited property, namely problem of not definiteness in the legislation of sequence of judicial executions in relation to the certification of agreement about the division of the inherited property and issuing of a certificate of a right on an inheritance.
