| Abstract: | В статье рассмотрены вопросы становления и развития третейского законодательства Германии, определены виды третейских судов и комиссий, полномочных рассматривать споры между сторонами. Основой для исследо- вания послужила деятельность одного из третейских судов – Немецкой институции по арбитражному делу (ДИС). Анализируются порядок избрания арбитров, отводов, сроки рассмотрения споров, количество дел, проводятся аналогии с деятельностью МКАС при Торгово-Промышленной Палате РФ. | Description: | In this article are considered questions of formation and development of the arbitration legislation of Germany, are defined types of the arbitration courts and the commissions, authoized to consider disputes between the parties. Activity of one of the arbitration courts – the German Institution of Arbitration (DIS) formed a basis for research. The review are analyzed the order of election of arbitrators, branches, terms of consideration of disputes, number of affairs, are drawn analogies to the International Commercial Arbitration Court at the RF Chamber of Commerce and Industry activity.
