The issue of cloning in the light of defining human legal and moral obligations

Abstract

Стаття присвячена розгляду проблеми клонування у світлі визначення правових та маральних обов’язків. Автором було визначено, що заборона репродуктивного клонування натепер зумовлює обов’язок кожного зберігати свою людську ідентичність і не допускати втручань, які б змогли негативно впливати на неї. В основі ідентифікації та закріплення правового статусу клона має лежати мотивація донора щодо виношування клонованої людини. Моральний зріз обов’язку при цьому пролягає крізь призму того, чи має право людина вирішувати питання про «статус» клонованого. На думку автора, несення обов’язків клоном та його відповідальність повинні бути тотожними до обов’язків та відповідальності, що притаманні будь-якій людині у подібних випадках.

The article deals with the problem of cloning in the light of defining legal and moral obligations. The author has determined that the prohibition of reproductive cloning today requires everyone to preserve their human identity and prevent interference that could adversely affect it. The identification and consolidation of the legal status of the clone must be based on the donor’s motivation for carrying the cloned person. The moral slice of obligations thus lies through the prism of whether a person has the right to resolve the issue of the “status” of the cloned one. In turn, in the author’s view, the clone’s responsibilities and responsibilities should be identical to those of any person in such cases.
