Реалізація принципів невідчужуваності та непорушності прав і свобод людини як конституційно-правова проблема

Abstract

Розглядаються теоретичні питання реалізації принципів невідчужуваності та непорушності прав і свобод людини, їх зв’язок з природними, невідчужуваними правами. Вказується на ті проблеми, які виникають в суспільстві та державі у зв’язку із закріпленням вказаних принципів в чинній Конституції України. Висловлені деякі рекомендації відносно реалізації цих принципів в умовах пострадянських реалій. Ключові слова: принцип, непорушність та невідчужуваність прав і свобод людини, природні та невідчужувані права, реалізація прав і свобод, втілення принципів.

It is described the theoretical questions of the implementation of the principles of human rights and freedoms inalienability and firmness, their connection with natural and inalienable rights. It is emphasized on the problems appeared in the society and the state because of the principles consolidation to the Constitution of Ukraine. It is proposed the principles implementation guidelines in the conditions of post-Soviet reality.
