Правова природа окремої думки судді Конституційного Суду України

Abstract

У статті наведені результати наукового аналізу правової природи окремої думки судді Конституційного Суду України. Визначено поняття та особливості окремої думки судді. Обгрунтовано необхідність окремої думки судді у конституційному судочинстві. Ключові слова: Конституційний Суд України, окрема думка судді, суддя Конституційного Суду України, рішення та висновки Конституційного Суду України, конституційне судочинство.

The results of scientific analysis of legal nature of the separate opinion of a judge of the Constitutional Court of Ukraine are represented in the article. The concept and features of the separate judicial opinion are defined. The necessity of the separate opinion of a judge in the constitutional proceedings is proved.
