Клопотання до органів прокуратури у кримінальному процесі

Abstract

У статті досліджено право учасників кримінального провадження заявляти клопотання на стадії досудового розслідування. Враховуючи вимоги Кримінального процесуального кодексу України та пропозиції науковців, пропонується розглядати клопотання як форму звернення до слідчого, прокурора, слідчого судді та суду, учасників кримінального провадження у вигляді офіційного прохання про здійснення спрямованих на реалізацію їх процесуальних прав і законних інтересів конкретних процесуальних дій або прийняття відповідних рішень. A right for the participants of criminal production to declare solicitors on the stage of pre-trial investigation is investigational in the article. Taking into account the requirements of the Criminal judicial code of Ukraine and suggestion of scientists, it is suggested to examine a solicitor as form of address to the investigator, public prosecutor, inquisitional judge and court of participants of criminal production as an official request about realization sent to realization of their judicial rights and legal interests of concrete judicial actions or acceptance of corresponding decisions.
