Abstract: У статті розглянуто комерційну концесію як форму інвестування у ресторанний бізнес. Досліджено правові основи комерційної концесії в законодавстві України. Установлено, що у країнах із розвинутою ринковою економікою більшість підприємств працює за схемою комерційної концесії в таких сферах, як ресторани й закусочні (відомі McDonald’s, Pizza Hut, Baskin Robbins), туризм і готельне господарство (Holiday Inn, Sheraton), індустрія безалкогольних напоїв (CocaСola, Pepsi, 7UP). Найбільш популярні договори комерційної концесії у сфері ресторанного бізнесу України такі: «Джигіт», «Франс.уа», Ріzza Celentano Ristorante, Salateira, Fornetti, Lviv Croissants, Aroma Kava , Grill Pab, Mafia, Coffelat, Druzi, Gemini espresso club, Mr.Grill Hotdogs & Burger, FreshLine, Black Honey, C&T CoffeeTea shop. The relevance of the development of commercial concession (franchise) relations is due to the fact that the widespread use and distribution of such a form of economic contractual cooperation, as a commercial concession, creates favorable conditions for the development of small business, since it is the institution of commercial concession (franchise) is one of the most common forms of investment and introducing innovations into the country’s economy. Due to these characteristics, franchising has been widely used in international practice, is a recognized economic and legal mechanism for enhancing investment relations and an important tool for implementing the state’s innovation and investment policy. The purpose of this work is to review the conceptual basis of commercial concession and the feasibility of its use in the restaurant business. Methodological basis of the study is the methods of analysis and synthesis, abstraction and generalization, system analysis and comparison. Based on the statutory definition, the commercial concession agreement refers to consensual, bilateral, paid and causal. The consensual nature of a commercial concession agreement is conditioned by the entry into force of the agreement from the time the parties reach agreement on the essential terms, while for real contracts it is not enough to reach an understanding of the essential conditions, they are considered concluded from the moment of transfer of the property defined by the contract. Currently in the catalog of franchises of Ukraine in the category catering about 400 franchises. In Ukraine, there are specialized companies that are preparing franchises for sale are engaged in the development of business plans, marketing, advertising the finished product, etc. Of the restaurateurs for such services they ask for $ 2,000, and they willingly pay, expecting to earn on the trade with their trademarks many times more. The most popular commercial concessions in the field of restaurant business in Ukraine are the following: Jigit, François, Rizza Celentano Ristorante, Salateira, Fornetti, Lviv Croissants, Aroma Coffee, Grill Pub, Mafia, Coffelat, Druzi, Gemini Espresso Club, Mr.Grill Hotdogs & Burger, Fresh-Line, Black Honey, C&T CoffeeTea shop.
